Section 6334(a)(1) of the Internal Revenue Code allows you to keep all of your clothing.  Bear in mind that the tax code uses the words “necessary” in describing the clothing that is exempt from IRS collections, meaning that the IRS can technically take clothing that is not necessary, like designer shoes and handbags, etc.
Section 6334(a)(2) of the tax code protects your furniture and household effects up to $7,900 in value from the IRS.  The IRS is not taking your television, or your bed, or lawnmower.

The Internal Revenue Manual, at Section 5.17.3.4.7, Property Exempt from Levy, restates these exemptions in guidance to IRS employees.

It is important to remember these exemptions when completing IRS financial statements, like Form 433A. Claim the value of these everyday items as exempt.  And in an offer in compromise, make sure that these assets are not included in the value of the offer as they are off limits to the IRS – again, claim it as exempt.

WHAT IS AN IRS "HARDSHIP STATUS"? ADVANCE TAX RELIEF

If you cannot pay your delinquent taxes because of an economic hardship, the IRS can suspend collection efforts against you.  This does not mean your debt is forgiven; just that the IRS will defer collection and not take your wages or bank account.



Internal Revenue Service Policy Statement 5-71 permits hardship status on IRS accounts, as follows:

If there are limited assets or income but it is determined that levy action would create a hardship, the liability may be reported as currently not collectible. A hardship exists if the levy action prevents the taxpayer from meeting necessary living expenses. In each case a determination must be made as to whether the levy would result in actual hardship, as distinguished from mere inconvenience to the taxpayer.  If, after taking all steps in the collection process, it is determined that an account receivable is currently not collectible, it should be so reported in order to remove it from active inventory.

Internally within the IRS, hardship aka currently not collectible, is known as a “53” case, for the transaction code the IRS inputs into your account to indicate a suspension of collection activities.
The IRS can also settle a hardship case by submission of an offer in compromise rather than have it linger in the system.

TAX RETURN PREPARER PLEADS GUILTY TO PREPARING FALSE TAX RETURNS

According to documents filed with the court, Marla Cunningham, 50, of San Diego, California, owned and operated Cunningham’s Tax Service, a tax preparation business in El Cajon, California. Cunningham admitted that she prepared false individual income tax returns for her clients for tax years 2008 through 2010 that included false charitable deductions, un-reimbursed employee expenses, education credits, medical and dental expenses and business expenses. Cunningham agreed that she caused a loss of more than $1.2 million.
Cunningham faces a statutory maximum sentence of three years in prison for each count of aiding and assisting in the preparation of a false return, a period of supervised release, restitution and monetary penalties at her sentencing scheduled for March 10, 2017.

HOW TO NEGOTIATE WITH AN IRS AUDITOR - ADVANCE TAX RELIEF

Despite IRS claims that auditors can’t negotiate. Give-and –take is part of the process.  An IRS Auditors job performance is based largely on how many cases closed – marked at “agreed”.



The Auditors wants you to consent to their findings and not appeal or go to Tax Court.  This gives you negotiating power. This means the auditor wants your signature so badly she will allow bogus business expenses or overlook unreported income.

Here is one negotiating strategy.

DO NOT JUST SIT THERE: Keep asking the auditor about disallowances she is considering as the audit progresses or they won’t tell you what’s on their mind so you can be in the dark until you get the examination report.

Don’t let an auditor take the easy way out – make her face and justify her actions.  In turn, you can argue your position right there and then. If she plans to make an adjustment because you didn’t produce records, you can ask for time to find or reconstruct the documents.

For Example:  The IRS Auditors tells Joseph an SEO consultant, that he is disallowing his deductions for the theft of his computer.  Joseph’s reason is that there is no documentation for the loss. John should instead get a police report for the Auditor.

NOTE: Keep in mind, the difference between arguing and negotiating.  Negotiating is the art of meeting in the middle.  For example:  Let’s say you lost all your paperwork for a $600 office supply deduction. The auditor proposes to disallow 100% of the deduction.

You can negotiate like “Since I made a profit and maintained an office, I must have bought office supplies. I lost my receipts, but my reconstruction of expenses is reasonable. I should be allowed at least 50%."
