PROTECT YOUR RECORDS.

Do not carry your Social Security card or other documents with your SSN on them. Only provide your SSN if it’s necessary and you know the person requesting it. Protect your personal information at home and protect your computers with anti-spam and anti-virus software. Routinely change passwords for Internet accounts.

DON'T FALL FOR SCAMS:

The IRS will not call you to demand immediate payment, nor will it call about taxes owed without first mailing you a bill. Beware of threatening phone calls from someone claiming to be from the IRS. If you have no reason to believe you owe taxes, report the incident to the Treasury Inspector General for Tax Administration (TIGTA) at 1-800-366-4484.

REPORT ID THEFT TO LAW ENFORCEMENT:

If your SSN was compromised and you think you may be the victim of tax-related ID theft, file a police report. You can also file a report with the Federal Trade Commission using the FTC Complaint Assistant. It’s also important to contact one of the three credit bureaus so they can place a freeze on your account.

COMPLETE AN IRS FORM 14039 ID THEFT AFFIDAVIT

Once you’ve filed a police report, file an IRS Form 14039 Identity Theft Affidavit. Print the form and mail or fax it according to the instructions. Continue to pay your taxes and file your tax return, even if you must do so by paper.

UNDERSTANDING IRS NOTICES.

Once the IRS verifies a taxpayer’s identity, the agency will mail a particular letter to the taxpayer. The notice says that the IRS is monitoring the taxpayer’s account. Some notices may contain a unique Identity Protection Personal Identification Number (IP PIN) for tax filing purposes.
IP PINs:

If a taxpayer reports that they are a victim of ID theft or the IRS identifies a taxpayer as being a victim, they will be issued an IP PIN. The IP PIN is a unique six-digit number that a victim of ID theft uses to file a tax return. In 2014, the IRS launched an IP PIN Pilot program. The program offers residents of Florida, Georgia and Washington, D.C., the opportunity to apply for an IP PIN, due to high levels of tax-related identity theft there.

DATA BREACHES:

If you learn about a data breach that may have compromised your personal information, keep in mind not every data breach results in identity theft. Further, not every identity theft case involves taxes. Make sure you know what kind of information has been stolen so you can take the appropriate steps before contacting the IRS.

REPORT SUSPICIOUS ACTIVITY:

If you suspect or know of an individual or business that is committing tax fraud, you can visit IRS.gov and follow the chart on How to Report Suspected Tax Fraud Activity.

COMBATING ID THEFT:

Over the past few years, nearly 2,000 people were convicted in connection with refund fraud related to identity theft. The average prison sentence for identity theft-related tax refund fraud grew to 43 months in 2014 from 38 months in 2013, with the longest sentence being 27 years.

$15 BILLION OF FRAUDULENT REFUNDS STOPPED

During 2014, the IRS stopped more than $15 billion of fraudulent refunds, including those related to identity theft. Additionally, as the IRS improves its processing filters, the agency has also been able to halt more suspicious returns before they are processed. So far this year, new fraud filters stopped about 3 million suspicious returns for review, an increase of more than 700,000 from the year before.

Here are some important facts to know about deducting costs related to job searches:

SAME OCCUPATION. Expenses are tax deductible when the job search is in a taxpayer’s current line of work.

RESUME COST. Costs associated in preparing and mailing a résumé are tax deductible.

3 SIGNS THE IRS IS ABOUT TO LEVY YOUR WAGES ON TAXES OWED - GET IRS HELP

1.     Has the IRS sent you a Final Notice of Intent to Levy and Notice of Rights to an Appeals Hearing?  

This is the grand daddy of all IRS collection notices, and is identified in the upper left hand corner as an LT11 letter.  By law the IRS has to send the Final Notice to you before they can levy.  After they send you the Final Notice, tax laws then make the IRS wait 30 days to levy. During this 30 day period, you have the right to stop the levy action by requesting that the IRS office of appeals review the case.  

This is called a Collection Due Process Appeal.

If you owe the IRS for back taxes, the agency has the authority to levy or seize your property. A specific type of levy is the garnishment of your employment wages each week. However, before the IRS starts to take a portion of your salary, there are specific guidelines it must follow. Understanding the IRS garnishment rules may help you prepare for the garnishment or even allow you to challenge and stop it.

IRS PROCEDURES PRIOR TO A WAGE GARNISHMENT

Once the IRS assesses your tax, you will generally receive notice and a Demand for Payment of the amount due. If you fail to pay this invoice, at some point after you will receive a Final Notice of Intent to Levy and a Notice of Your Right to a Hearing.

These last two documents must be sent at least 30 days before the IRS begins to garnish your wages. Before it reaches this point, you should contact the IRS and attempt to resolve the issue, possibly by submitting a request to get on a payment plan.

HOW MUCH THE IRS CAN

When the IRS moves forward with your wage garnishment, your employer has no choice but to comply with the IRS and remit a portion of your wages to the agency to pay your tax bill. The IRS has more garnishment power than ordinary creditors insofar as it is not subject to the state and federal garnishment limitations, which means it can leave you with very little money each week to live on.

During 2016 for example, a single parent with two children who files as head of household can be left with as little as $412.50 per week. This means that if you earn $1,000 per week, the IRS takes $587.50 of it, and if you earn $2,000 per week, it can take $1,587.50. However, the amount of your garnishment will depend on how much tax you owe.

WHEN YOU CAN STOP WAGE GARNISHMENTS

Unless the IRS agrees to an alternative resolution, such as a payment plan, there are a limited number of circumstances that require the IRS to cease garnishing your wages before your balance is paid in full. These include:

The IRS discovers that the time period to collect the tax from you expired before it served the garnishment notice

The IRS did not provide you the full 30 days to respond to the notice
You declare bankruptcy

The agency is considering your offer in compromise or request for installment plan when an appeal is in process.

APPEALING THE IRS GARNISHMENT

It is always possible to request an appeals conference during the initial 30-day period after receiving your final notices. This is referred to as a Collections Due Process (CDP) hearing.

However, you should be aware that this is not the appropriate forum to dispute the amount of tax you owe; the appeal only deals with issues relating to the garnishment, such as if the IRS violates one of its own procedures. Generally, you would’ve had the opportunity to dispute the tax long before the IRS sends the Final Notice of Intent to Levy.
